Legislation
In accordance with the provisions of the European GDPR Regulation of May 25, 2018, regarding the protection of individuals and the processing of personal data and the free movement of such data, as amended and supplemented, and Law No. 506/2004 regarding the processing of personal data and the protection of privacy in the electronic communications sector, Splendid Service SRL undertakes to manage and store in safe conditions and only for the specified purposes the personal data provided by various Users of the website. This data is collected for carrying out online commerce activities through the website www.gastroprofesional.ro.
Providing the data requested in the registration form is not mandatory. However, the lack thereof prevents us from processing your orders and delivering the desired products.
In accordance with the provisions of the European GDPR Regulation of May 25, 2018, Users have the right of access, the right of intervention over data, the right not to be subject to an individual decision, and the right to address the courts. At the same time, Users have the right to oppose the processing of personal data concerning them and to request the deletion thereof. This request shall be made in a written and signed application sent to the Data Operator, namely Splendid Service SRL, Strada Arcadie Septilici, no. 5B, Bacau County.
The online store GastroProfesional.ro holds usage rights over the content (images and texts) on the website. To report copyright infringement, send an email to: iulia@gastroprofesional.ro. Copying product information or images without the written consent of GastroProfesional.ro is considered intellectual property theft. Attempts of unauthorized access to the website and fraud attempts will be reported to the competent authorities.
The online store www.gastroprofesional.ro complies with the GPeC preselection criteria and has adhered to Trusted.ro standards.
Registration
To fully benefit from the services offered by our website, you need to create a User account. This is done by filling in the personal data requested in the form at the address http://gastroprofesional.ro/contul-meu. Additionally, supplementary data may be requested, necessary for issuing proforma or fiscal invoices and for product delivery.
It is mandatory that the data entered in the form be real. It is not permitted to enter false data or data that does not belong to you. After completing the subscription form, you will receive a confirmation email at the email address provided, confirming the creation of the User account.
The Operator reserves the right to refuse, without prior notice, the creation of an account if it is observed that the data entered in the form is not real or does not belong to you.
Confidentiality
The information you provide is used only by the Operator and by sales consultants who are employed under an employment contract, are subordinate to the Administrator, and have signed a confidentiality agreement. The information provided by Users is not communicated to any third party, except for delivery companies. The information provided is not transferred to any natural or legal entity outside of Romania.
The website Administrator reserves the right to block access for Users who violate the terms of use, the applicable legislation, or who post opinions and comments with offensive content.
The Operator may use User data for the purpose of informing them about their account status, for evaluating the products or services offered, or for notification through periodic newsletters about current offers. Any User who no longer wishes to receive the newsletter can unsubscribe by sending an email with the subject "Unsubscribe" to contact@gastroprofesional.ro.
Prices
On our website, product prices are displayed in Lei or Euro, VAT included. The base price of the products on the website is in Euro, and the conversion of prices to Lei is done taking into account the BNR (National Bank of Romania) exchange rate for the current month +1%.
The proforma invoice will be sent to the email address declared at the time of creating the user account and includes the stamp duty. No additional fees are charged.
In the event that a product price is displayed incorrectly due to a typographical error or incorrect information received from suppliers, the Operator has the right to refuse or cancel any order placed for that product. In the event that the User has already made the payment, the Operator undertakes to immediately refund the amount corresponding to the canceled order.
Product Payment
Payment for products ordered through the website www.gastroprofesional.ro is made in Lei in accordance with the invoices issued by the Operator and sent to the User at the email address specified in the identification data of their account.
The payment method can be cash for orders with a value less than 5,000 lei (VAT included) or by bank transfer with payment order for amounts greater than 5,000 lei.
Cash payment of the product value or handing over payment instruments can be done directly at our showroom in Bacau, str. Arcadie Septilici no. 5B, or through courier companies.
For products that are not in stock and require ordering from the supplier, an advance payment is required upon ordering.
According to art. 16 lit. c of O.G. 34/2014, if the Buyer chooses to purchase clearly customized products, made according to the specifications indicated by the Buyer, at their request, according to personal needs, the Buyer accepts that such products cannot be returned or replaced, being exempt from the right of return.
Delivery
The delivery term is expressed in business days (5 days/week). The delivery term starts from the moment of telephone confirmation of the order for cash on delivery orders, or from the date of payment receipt in the account.
Upon completing the order, the customer can choose from 3 shipping methods:
- Pickup at own responsibility from the Splendid Service Bacau warehouse
- Product delivery through specialized courier or transport companies
- Delivery to the Customer’s address using Splendid Service SRL’s own means of transport
Ordered products are delivered within the territory of Romania within the delivery term indicated at the time of placing the order.
Courier delivery is made to the customer’s address or to parcel pickup points at courier company addresses, as applicable. Unless the Seller and the Customer agree otherwise, equipment delivery is made at the building entrance. The Customer is responsible for handling the products inside the premises, on stairs, or by elevator (to upper floors).
The Seller cannot be held responsible for product damage during transport. If the customer notices the outer packaging is damaged, it is necessary to refuse the parcel upon receipt. If the customer still accepts the parcel, a written report must be drawn up with the delivery agent; otherwise, any subsequent complaint cannot be resolved.
The Buyer is obligated to inspect the product upon receipt, and if the product has defects, the Customer is obligated to notify the Seller within 48 hours of taking possession of the product for its repair.
Commissioning can be done for a fee by our company’s technicians if this is requested at the time of equipment purchase. For this, we will issue a price offer that must be accepted in writing by the customer. If commissioning was not requested, it can be done by an authorized company.
Limitation of Liability
Splendid Service SRL is not liable for damages caused, through no fault of its own, by the malfunctioning of the online store, as well as those resulting from the inability to access the online store pages (e.g., internet network failures or server failures of the hosting company).
Seller’s Obligations
The Seller provides the Customer with information and technical specifications regarding its products and services to achieve the purpose mentioned in the online order.
Splendid Service SRL is the holder of intellectual property rights over the online store, including trademarks, design, website functionalities, images, and technical specifications.
Product specifications and related technical documentation presented on the website are provided by manufacturers, with the Operator only providing technical support for their display.
Product images displayed on the website are for presentation purposes only. Actually ordered products may differ in certain characteristics (such as color shades) from the actual appearance of the product, depending on the production batch.
Product prices are updated periodically. The price of the ordered product is the one displayed at the date of placing the order.
Warranty
Products purchased by phone order or online through the website benefit from warranty under the conditions of GEO 140/2021. The warranty conditions differ from case to case, for individuals and for legal entities, respectively.
The warranty certificates issued together with the invoice contain all the necessary information about the warranty coverage, the warranty period, and the information needed to contact the authorized service centers.
If the purchased product is within the warranty period stipulated in the warranty certificate and complies with the conditions set forth in the certificate, it will be repaired free of charge by the authorized service centers. In this case, please send the product covered by the warranty at your own expense to the service center address mentioned in the warranty certificate - Str. Arcadie Septilici no. 5B, Bacau County, after completing the service form.
The warranty is fulfilled through repair. The warranty does not apply if the product serial number has been erased, modified, or is missing.
The term for remedying defects is 15 days from the date of notification. If this term cannot be met due to reasons independent of the service center, the customer will be notified about the earliest possible repair date and the reasons that led to the extension.
Service requests that result in the following findings: unpowered equipment, selection of an inappropriate operating mode for the equipment, will be considered unfounded interventions. The cost of an unfounded intervention is 250 lei excluding VAT/hour, plus transport fees.
Repairs during the warranty period are performed free of charge at the service center in Bacau, Strada Arcadie Septilici, no. 5B. If on-site intervention is requested at the location where the equipment is installed, the applicant agrees to pay the costs incurred by the mobile workshop deployment, namely 3 lei excluding VAT/km round trip.
Periodic maintenance during the warranty period is the responsibility of the buyer, according to the user instructions.
The following are excluded from warranty:
a) Consumable parts (bulbs);
b) Glass/plastic/chamotte/refractory brick parts;
c) Defects caused by overloads, interruptions, or incorrect connection of the electrical supply;
d) Defects caused by incorrect connection of optional accessories.
e) Defects resulting from handling or transport.
Product Returns
The commercial company that manages the GastroProfesional online store is a business-to-business company, with products primarily intended for legal entities and commercial spaces. Regarding products purchased by legal entities, according to GEO 34/2014, the company is not obligated to accept product returns.
If the consumer has a problem related to an order that does not appear to be resolvable by email or with the contact person, they can reach out for conciliation at the email address contact@gastroprofesional.ro.
Withdrawal from purchase. Products purchased remotely can be returned according to G.E.O. 34/2014. The consumer has the right to notify the seller in writing that they are withdrawing from the purchase, without penalties and without stating a reason, within 14 days of receiving the product.
The return of products shall be done at the customer’s expense, within 14 days of contract termination.
The Buyer has the right to withdraw from the Contract, i.e., to return a Good or to give up a Service, within 14 calendar days, without stating any reason and without bearing any costs other than delivery costs.
Thus, according to GEO no. 34/2014, the return period for a Good or withdrawal from a Service expires within 14 days from the day the Buyer takes physical possession of the Good – if the Buyer orders multiple products through a single order that will be delivered separately, the return period will be different for each individual product.
To return the product, you must notify us in writing, by mail (Str Alexandru cel Bun, no. 13, Bacau – Splendid Service) or by email (contact@gastroprofesional.ro). Only written requests will be considered. For the return request, you can use the return form available at this link as a template.
The refund of the returned products’ value will be made within a minimum of 2 days and a maximum of 14 days from receiving the products and analyzing their condition, provided the customer submits the necessary information for payment. Refunds will be made by bank transfer to the customer’s IBAN account, as provided by the customer.
The consumer is responsible for the decrease in the value of products resulting from handling them differently than what is necessary to establish the nature, characteristics, and functioning of the products.
In accordance with Directive 2011/83/EU, recital 47: to establish the nature, characteristics, and functioning of the goods, the consumer should handle and inspect them in the same manner as they would be permitted to do in a store.
Some products are marked with a seal applied by the manufacturer on the packaging. This seal is not mandatory; its presence is specific to the manufacturer. The presence of the seal is not mandatory to demonstrate that the product is in the exact form and condition in which it was released by the manufacturer. Damage to the seal does not limit the right of withdrawal from the contract in any way.
The returned product must be in the same condition as it was delivered (in the original packaging with all accessories, with intact labels and accompanying documents). Products that show physical modifications, impacts, chips, scratches, shocks, signs of excessive use, and/or unauthorized interventions, etc., will not be accepted for return.
If the Good is returned in a condition where it can no longer be sold as new (opened packaging, missing accessories, the Good is damaged), we reserve the right to charge a fee for restoring the Good to its original state, as applicable, or to cover the price difference resulting from selling the product as resealed, or, at the Buyer’s request, we will reship the Good, with shipping costs borne by the Buyer.
According to the legislation in force, withdrawal from purchase is applicable only to individual customers (natural persons).
PRODUCTS THAT CANNOT BE RETURNED:
Sealed products that cannot be returned for health protection or hygiene reasons and that have been unsealed by the consumer. Hygiene/personal care products that have been unsealed cannot be returned. Sealed audio or video recordings or sealed computer software that have been unsealed by the consumer.
Promotional Campaign Rules “Black Friday – discounts up to 60%”
1. THE ORGANIZER. The company “Splendid Service SRL”, supplier of professional equipment for the HoReCa industry (hereinafter referred to as “Splendid Service” or “the Organizer”), with registered office at str. Biericii 81, sat Barati, com. Margineni, jud. Bacau, registered at the Trade Registry under no. J04/361/1993, unique code RO 4014904, represented by Tereza Farauanu – as Administrator, launches the discount Campaign “Black Friday – discounts up to 60%” (hereinafter referred to as “the Campaign”) which will be carried out in accordance with this Regulation (hereinafter referred to as the Regulation) and in accordance with the applicable legislation in Romania. THE ORGANIZER reserves the right to modify any of the conditions established in this regulation during the discount campaign period.
2. PURPOSE. DURATION. TERRITORY. The promotional campaign is called “Black Friday – discounts up to 60%”. This Campaign is carried out under the conditions of the law and aims to promote Gastroprofesional products. The Campaign will take place during the period of November 12-14, 2021, on the website www.gastroprofesional.ro, within the limits of available stock. The last day of discounts is November 14, 2021, except in the event that the campaign is extended.
3. PRODUCTS PARTICIPATING IN THIS CAMPAIGN. The subject of the campaign is the products presented at this link: https://gastroprofesional.ro/promo/3-black-friday. The Campaign cannot be combined with any other campaign.
4. RIGHT AND CONDITIONS OF PARTICIPATION. Any natural or legal person who purchases one or more products that are the subject of this promotion during the mentioned periods benefits from this campaign.
5. CONDUCT OF THE PROMOTIONAL CAMPAIGN. The “Black Friday – discounts up to 60%” campaign will take place on the website www.gastroprofesional.ro. When purchasing the products mentioned in point 3 available in the gastroprofesional.ro online store, the buyer benefits from the corresponding discount from the price that would have been charged by the organizer in the absence of the campaign. The reduced sale price for granting the discount of up to 60% is calculated according to the following formula: Promo price = old sale price – X%.
6. IDENTIFICATION AND PURCHASE METHOD. A person may purchase multiple products that are the subject of this promotion if the products meet the conditions set forth in this regulation.
7. TAXES AND DUTIES. The campaign organizer is responsible for the payment of taxes or financial obligations, in accordance with the legal provisions in force.
8. DISPUTES. Any disagreements arising between the organizer and the participants in this promotional campaign will be resolved amicably, or if this is not possible, disputes will be settled by the competent Romanian courts.
9. INTERRUPTION OF THE PROMOTIONAL CAMPAIGN. The Organizer reserves the right to interrupt the Promotional Campaign at any time during its course, with prior notification to consumers through appropriate communication means (signage in stores).
10. PROMOTIONAL CAMPAIGN REGULATION. The promotional campaign regulation is available in all participating stores throughout the promotion period. Personal data – any information relating to an identified or identifiable natural or legal person; an identifiable person is one who can be identified, directly or indirectly, in particular by reference to an identification number or to one or more factors specific to their physical, physiological, psychological, economic, cultural, or social identity.
